Georgia Property & Deed Records
In Georgia, real estate documents are recorded with the Clerk of Superior Court in the county where the property is located. Unlike many states, Georgia uses a security deed (sometimes called a deed to secure debt) instead of a mortgage to collateralize loans. The Georgia Superior Court Clerks’ Cooperative Authority (GSCCCA) maintains an online index of real estate and lien filings statewide.
Where to Search
- Clerk of Superior Court: Access deed, security deed, plat and lien records through the county clerk’s office. Many counties participate in the GSCCCA’s eSearch portal at gsccca.org.
- Tax Assessor: County tax assessors provide parcel searches to view ownership information, assessed values and tax bills.
- Tax Commissioner: Responsible for property tax collection and delinquent tax sales. Lists of redeemable tax deed auctions are often posted on the county website.
Steps to Locate a Deed
- Identify the county where the property is located.
- Search the GSCCCA index or visit the county clerk’s online records search.
- Locate the deed by grantor/grantee names or by property description.
- Review the document image for the legal description and covenants.
- Request a certified copy from the clerk if required.
Georgia Tax Deed Sales
Georgia is a redeemable tax deed state. When taxes remain unpaid, the county conducts a public auction where the highest bidder receives a tax deed. The former owner has a redemption period of one year during which they can repay the taxes plus penalties and reclaim the property. If redemption does not occur, the bidder can foreclose the right to redeem and obtain a fee simple deed.
Register with the county tax commissioner to bid at auctions, and research title, liens and property condition beforehand.
